HENDERSON, Judge.

Appellant was convicted of murder in the first degree, and his punishment fixed at confinement in the penitentiary for life; hence this appeal.

The inculpating evidence is of a circumstantial character, and is to the effect that appellant and deceased Avere at the time of the alleged homicide neighbors. Appellant was living in the little village of Loyal Valley, and was engaged with his father in keeping a store. His father lived at one end of the village and he at the other end, some three hundred or four hundred yards apart, and both on or near the Mason and Llano road,…
