Action was begun by Armstrong to enjoin foreclosure of his deed of trust in favor of the Alliance Trust Company, Limited, for accounting and for damages ex delicto, resulting from an alleged defamation. No point seems to have been made of the rather unique joinder of an •unliquidated claim for damages with a bill for an accounting against which balance any award was to be credited. The defendants were P. B. Barcroft, individually and as trustee in the deed of trust, C. F.
