A number of exceptions were taken to the rulings of 'the trial court, and such of them as are deemed of material importance will now be briefly considered.

1. Before the trial began the court appointed Hon. W. S. Stroud, county judge of Columbia county, as counsel to assist the district attorney in the prosecution, by virtue of the provisions of sec. 750, Stats. 1898, which provides that circuit courts may in their discretion appoint counsel to assist the distinct attorney in the prosecution of persons charged with crime punishable by imprisonment in the state prison.
