delivered the opinion of the court.

Appellee as executor of the estate of Francis J. O’Brien, deceased, recovered a judgment in a justice court against appellant upon a policy of insurance issued November 27, 1899, by appellant on the life of the deceased. Upon appeal to the Circuit Court the cause was submitted to the court and was tried by him. The court found the issues for appellee and assessed his damages at $200. Appellant now brings the cause to this court.
