This is an original proceeding in mandamus brought in the name of the State of Missouri at the relation of Lane B. Henderson, attorney for Raymond Schwada, the duly appointed, qualified and acting administrator of the estate of Frank Allen Schwada, deceased, late a resident of Shelby County, against the respondents Thomas V. Proctor and Mary E. Hart-grove, respectively, the Judge and Clerk of the Probate Court of said County.
