*737The plaintiff Fernando Montoya (hereinafter the plaintiff) allegedly sustained personal injuries when he impaled his foot after stepping on a five-inch high piece of broken-off metal signpost protruding from the sidewalk surface abutting certain premises in Queens (hereinafter the premises).
