1. In view of the answer of the trial judge to the petition for certiorari, no abuse of discretion appears in his refusal to continue the case.
2. There was no error in overruling the demurrer to the petition.
3. In the light of the untraversed answer of the trial judge to the petition for certiorari, there is no merit in any of the various assignments of error therein, except the one which complains that on the hearing of the motion for a new trial the court passed an order overruling the motion, provided that the plaintiff would within ten days write off $4.40 from the judgment.
