Macon County Greyhound Park, Inc. (MCGP) appeals the district court’s grant of summary judgment for appellees, MCGP employees Judy Weekes-Walker, et. al (Weekes-Walker), on appellees’ claims under the Worker Adjustment and Retraining Act of 1988 (WARN Act), 29 U.S.C. §§ 2101-2109, and as to MCGP’s assertion of the unforeseeable business circumstances defense, 29 U.S.C. § 2102(b)(2)(A).
