—Order, Supreme Court, Bronx County (Barry Salman, J.), entered March 24, 2000, which denied defendants’ motion for an order dismissing the complaint pursuant to CPLR 3404, and restored the case to the calendar upon the condition that counsel for plaintiffs pay $250 in costs to defendants, unanimously reversed, on the law, the facts and in the exercise of discretion, without costs, defendants’ motion granted, and the complaint dismissed.
