On April 18, 1967, the Montgomery County Council, sitting as the District Council for that portion of the Maryland-Washington .Regional District located in Montgomery County, adopted resolution No. 6-380 granting the rezoning requested in zoning application No. E-955. An appeal from this action was taken to the Circuit Court for Montgomery County by the appellees here, and on September 21, 1967, Judge James H.
