CARDAMONE, Circuit Judge:

Michael G. Morgan takes this interlocutory appeal from the denial of a motion to dismiss a pending indictment against him entered in the United States District Court for the District of Connecticut on January 21, 1994, before Judge T.F. Gilroy Daly. The appeal raises a question as to whether defendant’s constitutional right against being twice put in jeopardy for the same offense was violated.
