This is a suit in equity instituted in the circuit court of Taylor County in December, 1895, by Melissa Deariing and John C. Dearing, her husband, against Thomas T. Selvey, executor of the will of James Selvey, deceased, and the five children of the plain*6tiffs, all of whom are infants, to surcharge and falsify the settlements made by the executor and to require him to pay over certain sums of money which had come into his hands by virtue of the will and in his capacity as executor, as is contended by the plaintiffs, and in part by virtue of the will and in part by virtue…
