The appellant was convicted of violation of section 722, subdivision 6, of the Penal Law, and the complaint *853before the magistrate alleged that on the 7th day of January, 1931, in the elevator of the subway station at One Hundred and Eighty-first street and St. Nicholas avenue, in the county of New York, the appellant did “ push and jostle an unknown individual, placing his (defendant’s) left hand under overcoat and in proximity of said individual’s left rear pocket of trousers worn by said individual.” This allegation closely follows the wording of subdivision 6 of section…
