This is an action of contract on a promissory note made by a corporation and indorsed by the defendant Perlmuter, hereafter referred to as the defendant. There was testimony tending to show that the original rate of interest on the note was five per cent; that the rate was subsequently changed to five and one half per cent, then to six per cent, and finally to seven per cent; and that payments of interest as indorsed on the note were calculated at these successive rates.
