PARKER, Circuit Judge.

This is an appeal from a final decree 'dismissing a bill of complaint and intervening petitions adopting its allegations. The complainants were stockholders and creditors of the failed National Bank of New Bern and' creditors of the failed First National Bank of New Bern, which prior to its failure had taken over the assets and assumed the liabilities of the former.
