SWINFORD, District Judge.

This is an action seeking an injunction to which the plaintiff asserts he is entitled on the following facts:

The plaintiff is a Negro citizen of the United States and resident of Mobile, Alabama. He is a locomotive fireman employed by the defendant Louisville & Nashville Railroad Company. He brings this action as a class action on behalf of all Negro employees similarly situated.
