This is an appeal by the defendants from an order of the circuit court granting a new trial of the action. The case was here at a former term, on appeal from final judgment therein for the plaintiffs, and is reported in 45 Wis., 60. The report contains a full statement of the case, which it is unnecessary to repeat here.
