This appeal is from a judgment of a district court of Wichita county refusing to probate the lost will of George E. Stearns, deceased. Dave Shepherd, the proponent and guardian. of Louada Stearns and Evelyn Steams, minors, has duly appealed from the judgment. The jurisdiction of the district court is not questioned, and the case is before us on the trial court’s conclusions of fact and law, without a statement of facts. The trial court found that George E. Stearns died on or about February 16, 1928, and that at the time of his death he owned lots 13 and 14 in block 112 of the original town…
