This action is founded on. two written instruments; one, a deed of conveyance of the real estate in controversy -r and ' two, a will subsequently made by the grantor'in the deed. The material facts- charged in the complaint are these: That Clement G. Rickets, being the absolute owner in fee of the premises described in the complaint, on the 12th day of January, 1856, by a general warranty deed, conveyed the said premises, in fee, directly to.
