Action by the National Bank of Newberry to foreclose a mortgage upon real estate given to it by the defendant Mills M. Livingston on March 18, 1926, to secure a note for $5,-806.54, dated on that day and due October 15, 1926, with interest after maturity at 8 per cent, per annum and 10 per cent, attorney’s fees. The mortgage was duly recorded on the day of its delivery, March 18, 1926.
