In this wrongful death and survival action, National Convenience Stores Incorporated (“NCS”) appeals a judgment entered upon a jury verdict in favor of G.P. Matherne, as Administrator of the Estate of Ramon A. Tamez, and on behalf of Ida Tamez, Brittany Diane Tamez and Graciela I. Martinez on the grounds that there is no competent evidence: (1) that NCS breached any duty it owed to its employee; (2) that NCS’s conduct proximately caused the accident; and (3) to support the damages for conscious pain and suffering or medical expenses.
