MEMORANDUM OPINION
BOWDRE, District Judge.
This case came before the court for a non-jury trial on the merits, consolidated with the Plaintiffs’ request for a preliminary injunction, on January 15-16, 2002. After two days of testimony, the court allowed the parties to submit additional evidence by deposition excerpts, and to submit their arguments 'through briefs. On March 18, 2002, the court held a conference with counsel and parties in an unsuccessful effort to resolve the case.
