MOORE, Circuit Judge:
This is an appeal by Shulman Transport Enterprises, Inc. (“Shulman”) from a summary judgment in the amount of $8,346.62 entered in a subrogation action brought by consignee’s insurance carrier, Hanover Insurance Company (“Hanover”), for damages caused to a C-45 Bliss Press during shipment from New York, New York to San Juan, Puerto Rico. The case presents the important question whether a shipping carrier can limit its liability below the $500 per package, or customary freight unit, provision of § 4(5) of the Carriage of Goods by Sea Act (“COGSA”), 46 U.S.C. § 1304(5).…
