Plaintiff, Cheryl Eberg, brings this action against Defendant, the United States Department of Defense. Plaintiffs Complaint'[Doc. No. i] states two claims under the Freedom of Information Act (“FOIA”), 5 U.S.C. § 552 et seq.: (1) that Defendant failed to release responsive, non-exempt records in violation of FOIA, 5 U.S.C. § 552(a)(3)(A); and (2) that Defendant failed to make a reasonable effort to search for responsive records in violation of FOIA,- 5 U.S.C. § 552(a)(3)(C).
