The controversy involved in this case is the result of a series of transactions between the parties. The defendant A. A. Clark did business in the name of A. A. Clark & Company.

In December, 1909, plaintiff borrowed $600 of the defendant, executing a note in the sum of $600, with interest at the rate of 8 per cent. This money was used in making the initial payment upon the purchase price of certain hotel *905property in.-Lake View, Iowa, which, included the hotel furniture.
