Petitioner, the Chesapeake and Ohio Railroad Company, on the 25th day of October,"1870, filed its petition in the Circuit Court of Kanawha county, representing that the line of its road had been located by its engineers through and over certain lands therein mentioned and described, giving the boundaries of the land sur*227veyed for its railroad.
