Appeal by the defendant, The Consolidated Gas Company of New York, from a judgment of the Supreme Court in'favor of the plaintiff, entered in the office of the clerk of the county of New York on the 5th day of June, 1903, upon the verdict of a jury for $650, and also from an order entered in said clerk’s office oh the 8tli day of June, 1903, denying the defendant’s motion for a new - trial made upon the minutes.

Ingraham, J.:

By this action the plaintiff sought to -hold ..the: defendant responsible for an injury sustained by him in consequence of the explosion of gas in the cellar of a tenement house in which the plaintiff resided. The defendant is engaged in supplying illuminating- gas in the city of New York, and supplied such gas for the premises in question, and for that purpose maintains gas mains in the street and *167a service pipe connecting such mains with the gas pipes in the .building. The complaint alleges that this service pipe connecting the defendant’s mains with the gas pipes in the house…
