The plaintiff in this action in tort for personal injuries had verdicts under a count for negligence and a count for maintaining a nuisance. These are the defendant’s exceptions to the denial of his motions for a directed verdict on each count and of his motion for a new trial based on the claim of an excessive award. The defendant is the executor of the will of one Ira L. Jenkins who on February 28, 1952, was the operator (hereinafter called the “occupant”) of the Dudley Super Market at 2337 Washington Street, Boston.
