The case, as presented, depends largely on questions of law, the facts being practical!y undisputed.

The complainant is the wife of the respondent Tierney and has lived separate and apart from him for a number of years, following the decision of the court in a bed and board divorce case. The respondent Tierney and the respondent Mrs. Flanagan, who is his sister, are owners as tenants in common of a valuable parcel of real estate with, a 'building thereon, situated in Providence.
