The following from the order of the lower court correctly states and disposes of the issues in this appeal:

“This action is one under the Uniform Declaratory Judgment Act, Section 10-2001, et seq., 1962 Code of Laws, to construe the rights of the parties hereto under the Will of *399Thomas W.
