The Continental insurance company brought suit in the Northern District of Illinois under 28 U.S.C. § 1333 (admiralty) against two of its insureds, McDonough Marine Service and Anderson Excavating & Wrecking Company, seeking a declaration that it was not liable to them on their policies. Anderson had been hired by the Army Corps of Engineers to demolish the wall of a concrete lock in the Mississippi River and remove the debris. It chartered barges from McDonough.
