CODY, Justice.

This was a suit by appellee, a general contractor, to recover from appellant the balance of the unpaid contract price for the construction of a building in the City of Houston, which appellee alleged he had performed according to the terms of their written contract. And, as ancillary to his suit, appellee sought to impress a statutory lien upon the building and premises, to foreclose it, and to recover attorney’s fees.
