MILLS, District Judge:

The cardinal issue: RICO.

This matter is before the Court upon Defendant’s motion to dismiss Count VI of Plaintiff’s amended complaint, which alleges that Defendants have engaged in a “pattern of racketeering activity” in violation of the Racketeer Influenced and Corrupt Organizations Act (RICO), 18 U.S.C. § 1961 et seq. Fleet Management Systems, Inc., d/b/a Logistics Systems (Logistics) charges that Archer-Daniels-Midland Co., Inc. (ADM), and NIMS Associates, Inc., (NIMS), violated 18 U.S.C. §§ 1964(c) and (d), as well as state common law and federal copyright law,…
