November 16, 1908. The opinion of the Court was delivered by The defendant is a corporation, owning and operating a cotton mill on South Tiger River, in Spartanburg county. It has constructed a dam, between forty and fifty feet in height, for the storage of the water of the river by which the mill is operated. In accordance with the method approved by engineers and the custom of cotton mills in this State, the water is held back and stored at night and from midday on Saturday until Monday morning while the mill is not running, in order to increase the volume of water and the available power…
