ORDER ON MOTIONS FOR SUMMARY JUDGMENT
ATKINS, District Judge.
This order grants in part and denies in part the motions for summary judgment filed by the State of Israel and the Intervenor Dade Trading Corp.
I FACTS
On December 17, 1963, the Nili-Somerfin Car Ferries Limited1 2(hereinafter Owner-Mortgagor) contracted 8 with the Fairfield Shipbuilding & Engineering Company Limited of Govan, Glasgow, Scotland (hereinafter Builder) for construction of the vessel involved here (hereinafter Nili).
