The plaintiffs, Thomas Kapalczynsld and Kathleen Kapalczynsld (husband and wife), commenced this action to recover damages resulting from injuries sustained by Kathleen Kapalczynsld when she fell into a hole in a street in Manistee, Michigan. The hole was at an access point to gas transmission lines running under the street. The access point and the transmission lines are owned by defendant Michigan Consolidated Gas Company.
