Perkins filed ¿n equitable petition against “the Board of Drainage Commissioners of the First District” of Banks County, alleging, in substance, that- said board had procured a contractor to construct a drainage canal through designated lands of petitioner; that the contractor had not completed the work as specified in the contract, and by reason thereof the land of petitioner was being damaged; that petitioner was the official superintendent of construction appointed by the drainage commission, and as such had reported the failure of the contractor, as above stated; that…
