In 2020, the people of Georgia ratified an amendment to Article I, Section II, Paragraph V (b) (1) of the Georgia Constitution that provides a waiver of sovereign immunity for actions seeking declar- atory relief from certain unlawful acts of the State or a local govern- ment. That amendment also added a procedural requirement: an ac- tion brought “pursuant to” this paragraph must be brought against and in the name of only the State or the relevant local government, or it “shall be dismissed.”…
