On August 29, 1962 tbe Circuit Court of Winnebago County entered judgment by confession on a promissory note in favor of plaintiffs and against defendants, Donald H. Barnes and Mary Lou Barnes, in the amount of $3,987.26. On September 26, 1962 defendants filed a motion supported by affidavit to open the judgment. The, affidavit recited that subsequent to the execution of the note upon which the judgment was confessed, the defendant, Donald H. Barnes was adjudicated a bankrupt, and that plaintiffs had actual notice of said bankruptcy proceeding. On the same date defendants filed a jury demand.…
