ORDER ON MOTION TO DISMISS

PHILLIPS, District Judge.

I. Introduction

In this declaratory judgment action, plaintiffs seek the Court’s declaration that certain Oklahoma statutes relating to the oil and gas industry are unconstitutional. Presently at issue is defendants' motion to dismiss the action. For the reasons set forth below, the Court dismisses plaintiffs’ preemption claim and abstains from deciding the remaining claims in plaintiffs’ second amended complaint.
