This is a motion based on a petition seeking to direct the Secretary of State of the State of New York, respondent, to accept and file a certain “ Independent Nominating Petition ” containing over 28,000 signatures purporting to place in nomination for the office of State Comptroller to be filled at the general election to be held on November 4, 1941, one Frank C. Moore, who has also been nominated by the Republican Party.
