On October 31, 1979, plaintiff T. Jack Hurt filed a complaint in the Superior Court of Cobb County, State of Georgia, against defendants Cypress Bank, Benjamin L. Hurt, Best Quality Supply Co., Inc. (hereinafter “Supply Co.”), Best Quality Drywall & Building, Inc. (hereinafter “Drywall”), and Atlantic National Bank of Broward (hereinafter “Atlantic Bank”).
