This is an appeal on questions of law from a judgment of conviction and sentence, by the Common Pleas Court of Seneca County, Ohio, rendered upon a verdict of guilty of an offense charged in an indictment returned by a grand jury of said county.

The indictment mentioned is based on the provisions of Section 12439, General Code, which reads as follows:
