CLIFFORD, Justice.

[¶ 1] Dennis Calden, Timothy Calden and Bonny Femald appeal from a judgment entered in the Oxford County Probate Court (Hanley, J.) determining that Elizabeth Cal-den, as the heir of her deceased husband, was entitled to share in the distribution of Gladys Calden’s estate.

[¶ 2] In July 1961, Gladys Calden executed a will containing the following provision:

In the event that my said husband, Richard F. Calden, does not survive me, or if there should not be sufficient evidence that he and I died other than simultaneously, then I give, bequeath and devise all of said rest,…
