From a decree dismissing the bill, complainant appeals. Quo warranto proceedings by the people of the State of Michigan, on the relation of John E. Bird, attorney general, to determine the validity of the franchise of the Detroit, Grand Haven & Milwaukee Railway Company.

By these two suits the State of Michigan, through its legal department, for the third time attacks in the courts the validity of the special charter under which the respondent was organized, and under which it has conducted its business for more than half a century. The first suit was brought in the circuit court for the county of Ingham to collect taxes assessed against the respondent under section 49, Act No. 123, and Act No. 133, Pub.
