In a hybrid proceeding pursuant to CPLR article 78 to review a determination of the Town of North Hempstead Board of Zoning and Appeals dated May 25, 2011, which, after a hearing, granted the application of Manhasset Pizza, LLC, for area variances and a conditional use permit, and action for a judgment declaring, in effect, that the proposed project requires a use *709variance, the petitioner/plaintiff appeals from a judgment of the Supreme Court, Nassau County (Jaeger, J.), dated February 14, 2012, which, inter alia, denied the petition and dismissed the proceeding.
