MEMORANDUM AND ORDER
BUA, District Judge.
Before the Court is defendant’s motion for summary judgment in this action by *403plaintiff for attorneys’ fees and costs. Plaintiff has also filed a motion to strike portions of defendant’s motion for summary judgment. For the reasons stated herein, defendant’s motion for summary judgment is granted in part and denied in part, and plaintiff’s motion to strike is denied.
