DROWOTA, Justice.

Doris Chu Lam, Herman Lam, and Winnie Lam appeal from the Court of Appeals’ affir-mance of the trial court’s dismissal of their negligence action against Kimber Smith on statute of limitations grounds. The issue for our determination is whether the lower courts erred in holding that Tenn.Code Ann. § 28-1-111, the “suspension statute,” was inapplicable and thus failed to toll the one-year statute of limitations because the defendant Smith could have been served pursuant to Tenn.
