The Flint & Fere Marquette Railroad Company filed its petition in the circuit court for the county of Saginaw for the purpose of condemning private property for the public use, under the power of eminent domain granted to railroad companies under the general railroad laws of this State.

The petition sets forth that the petitioner had surveyed the route for a proposed spur track, to be owned and operated by it, connected with its main line at apoint near the west bank of the Saginaw river, in Saginaw county, and extending thence southerly, on the westerly side of Saginawriver, across the track…
