Clarke, P. J.:

The plaintiff is the author of a book entitled “ The Genius.” The defendant is a domestic corporation engaged in the business *774of selling, advertising and publishing books and periodicals. On the 30th day of July, 1914, plaintiff and defendant entered into a contract for the sale, advertisement and publication of said book under which plaintiff guaranteed to the defendant that it contained nothing of a scandalous, immoral or libelous nature.
